Federal Constitution, City Statute and the Casa Verde e Amarela Program: peculiarities for housing improvement and land title regularization

Brazil's Urban Policy advanced over time, especially after the promulgation of the Federal Constitution of 1988, with the subsequent positivization of the City Statute. However, the housing deficit and land irregularity remain high in the 2020s, which requires the implementation of programs that aim to overcome them. Thus, this research aims to analyze the Brazilian Housing Policy as an alternative to the housing deficit and land irregularity in Brazil, with emphasis on the Federal Constitution of 1988, the City Statute and the Casa Verde e Amarela Program. To this end, was examined this institutes in the light of the precepts of land title regularization and housing adequacy. The Federal Constitution expressly contemplated the right to housing, the social function of property and land regularization, which shows its concern with the housing deficit and urban informality; the City Statute regulated the articles of the Federal Constitution's Urban Policy, establishing parameters for territorial ordering and ratified the need for land tenure regularization by inserting it in one of its guidelines; the Casa Verde e Amarela Program contemplated a specific axis for land title regularization and housing improvement, innovating in relation to other programs by associating construction and land tenure aspects to address urban weaknesses. Therefore, these instruments strongly recommend and collaborate to overcome the land tenure irregularity and housing deficit in Brazil, with the need for their implementation so that they fulfill their role associated with these issues.
