Environmental refugees: a perspective of legal recognition versus factical conceptualization

Environmental changes in areas of high vulnerability have been identified as the cause of significant population migrations, due to the impossibility of staying in the affected locations. Thus, communities and entire populations are forced to leave their natural habitat in search of survival in other regions, highlighting, in this context, the involuntary displacements that generate what is called “environmental refuge”. Environmental refugees are a class that does not formally conform to the concept of refugee present in legal texts, resolutions or protocols of International Refugee Law. Currently, issues involving the environment are not considered as hypotheses for recognition of refugee status. Thus, this research sought to identify the existing difficulties for the legal recognition of displacements due to environmental factors such as refuge situations, bringing light to a necessary conceptual restructuring, emphasizing that legal and political instruments did not follow the dynamism of migrations. Finally, in addition to highlighting the need for legal provision for the proper protection of refugees, certain economic and political interests were also highlighted that end up corroborating the non-official recognition of the status of environmental refugees.
