Legal and environmental perspective of water resources management in Amapá state, Oriental Amazon

The present investigation approach the management of water resources in the state of Amapá was evaluated emphasizing the legal, organizational-institutional and integrated aspects during the period between 2014 and 2017. We consider the relevant internal contradictions of the normative system that indirectly impact its efficiency. A systematic literature review on the environmental and historical-law principles of water management was performed, as well as an analysis of the Water Resources Management System (SGRH-AP), from implementation to the evolution of management actions provided for in Law 0686/2002. Methodologically, it was observed in the classification, granting and control of water pollution, and conflicts in some watersheds. The results indicate that Amapá State is ranked in the elementary level of development of its SGRH, a direct consequence of the obstacles presented by the Public Sector to implement decentralized management. Likewise, the lack of organization and institutional planning naturally caused a series of noncompliance with the sector's strategic goals. This scenario shows a stagnation situation of the SGRH, resulting directly in the stagnation of regulatory frameworks. The obligation of integrated, decentralized and participatory management has not been strictly enforced. We concluded that a reorganization of the sector is yet necessary to implement the state's water management objectives and guidelines.
