Brazilian judicial performance: the efficiency of state courts using the DEA method

The present background of financial and social impacts aggravated by the covid-19 pandemic carried challenges to Public Administration management, highlighting the importance of measuring performance over indicators. As the provision of jurisdictional activity is an essential and fundamental in the realization of the right of access to justice, this study aims to analyse the efficiency of the Brazilian State Courts of Justice, comparatively, between 2019 and 2020. The research is empirical and quantitative, using the Data Envelopment Analysis (DEA) technique, output-oriented CCR model. The data were extracted from the publication Justice in Numbers elaborated by the National Council of Justice. It was found that the Courts of Justice of Rio de Janeiro and Espírito Santo were considered the most efficient in 2019, with only the first remaining as a benchmark in 2020. The results suggest, in light of the selected variables, that the pandemic had a negative impact on the performance of most Courts, represented by the decrease in efficiency levels. The increase in the number of personnel and the decrease in the filing of new lawsuits had a positive effect on efficiency; already the largest total expense, a negative effect. Finally, the higher productivity number of judges did not necessarily indicate a higher degree of efficiency.
